A non-admitted carrier is an insurance company that is not licensed by the California Department of Insurance (CDI). However, “non-admitted” does not mean unregulated.
- Regulatory Oversight: These carriers are regulated by their home state or country and are monitored in California by the Surplus Line Association of California (SLA).
- Purpose: They serve as a “market of last resort” for risks that standard, admitted insurers refuse to cover because the risk is too high, unusual, or complex.

- Admitted: If an admitted carrier goes bankrupt, the California Insurance Guarantee Association (CIGA) steps in to pay outstanding claims.
- Non-Admitted: There is no state-backed protection. If the carrier fails, you could be responsible for your own losses. This is why checking a carrier’s A.M. Best rating for financial strength is vital.
2. Consumer Appeals
- Admitted: You have the right to appeal claim disputes directly to the California Insurance Commissioner.
- Non-Admitted: You generally have no right to appeal to the state. Disputes must be handled directly with the carrier or through a surplus lines broker.
3. Flexibility vs. Cost
- Flexibility: Non-admitted carriers have much more freedom to customize policy language and rates, which is often the only way to get coverage for “hard-to-place” risks.
- Extra Fees: Policies from non-admitted carriers often include a Surplus Lines Tax (approx. 3–4%) and a stamping fee that admitted policies do not have.
