If you’ve recently been dropped by your homeowners insurance carrier — or can’t find coverage in the standard market — you may have been pointed toward the California FAIR Plan. While the FAIR Plan can be a lifeline for homeowners in high-risk areas, there are critical gaps in its coverage that can leave you dangerously underprotected. Here’s what you need to know before you sign.
What Is the CA FAIR Plan?
The California FAIR (Fair Access to Insurance Requirements) Plan is a state-mandated insurance pool designed to provide basic fire insurance to property owners who cannot obtain coverage in the traditional marketplace. It is not a full homeowners policy — it is a bare-bones fire policy, and it shows.
In recent years, as major insurers have pulled back from wildfire-prone areas across California, more and more homeowners have found themselves relying on the FAIR Plan as their only option. That makes understanding exactly what it covers — and what it doesn’t — more important than ever.
The Big Warning: The FAIR Plan Alone Is NOT Enough
This is the most important thing to understand: the CA FAIR Plan only covers what you specifically purchase. The base policy covers fire and lightning. That’s it. Everything else — windstorm, hail, explosion, riot, vandalism, smoke damage — is optional, and many policyholders don’t realize they need to ask for it.
⚠️ What Is NOT Automatically Covered
If you purchase only the base FAIR Plan policy, you will have no coverage for:
- Windstorm or Hail
- Explosion
- Smoke (including from wildfires)
- Riot or Civil Commotion
- Aircraft or Vehicles
- Volcanic Eruption
- Vandalism or Malicious Mischief (including damage by burglars)
These are all optional add-ons that must be specifically requested and purchased.
The “Difference in Conditions” Problem
Here’s where it gets even more serious. Many homeowners pair their CA FAIR Plan with a separate Difference in Conditions (DIC) policy to fill the gaps the FAIR Plan doesn’t cover. This is actually a smart strategy — when done correctly.
However, DIC policies often include a Fire, Extended Coverage and Vandalism Exclusion endorsement. This means the DIC policy intentionally excludes fire, explosion, smoke, windstorm, vandalism, and related perils — because it assumes those perils are being covered by the FAIR Plan.
The result: if your FAIR Plan doesn’t include Extended Coverage and Vandalism, and your DIC policy excludes those same perils, you end up with a policy on both sides that covers nothing in between.
The DIC endorsement is explicit: failure to purchase optional coverages through the FAIR Plan — including extended coverage and vandalism/malicious mischief — will result in a gap in coverage. And that gap can cost you everything.
What You MUST Ask Your Agent to Add
When purchasing a CA FAIR Plan policy, always insist that your agent include:
1. Extended Coverage — This adds protection for:
- Windstorm or Hail
- Explosion
- Riot or Civil Commotion
- Aircraft
- Vehicles
- Smoke
2. Vandalism or Malicious Mischief — Covers intentional damage to your property, including damage caused by burglars.
These are not automatically included. You must ask for them by name. Do not assume they are part of your policy unless you have it in writing.
Don’t Get Caught in the Coverage Gap
The scenario that keeps insurance professionals up at night: a homeowner suffers a major loss — a windstorm tears off the roof, or vandals destroy the property — and they file a claim only to discover that neither their FAIR Plan nor their DIC policy covers the damage. The FAIR Plan didn’t include Extended Coverage. The DIC policy excluded it. The result is a complete denial of the claim.
This is not a hypothetical. It happens. And it is entirely preventable.
Work With an Agent Who Knows the Difference
The CA FAIR Plan system is complex, and the stakes are high. This is not the time to buy a policy online and hope for the best. You need an experienced agent who will review your complete coverage picture — FAIR Plan and DIC — to make sure there are no dangerous gaps.
